The New Government Procurement Act (NGPA) or Republic Act No. 12009 continues to include the Negotiated Procurement for Lease of Real Property and Venue provision from the Government Procurement Reform Act (GPRA) or Republic Act No. 9184. This provision emphasizes the preference for using government-owned properties or venues for official government functions.

For official purposes, government agencies are encouraged to lease properties or venues owned by other government entities. If a suitable publicly-owned property or venue is available that meets the Procuring Entity’s requirements, a lease agreement can be made with the government-agency owner. If the Procuring Entity opts for privately-owned properties or venues, it must be justified as more efficient and cost-effective for the government.
