The Take-Over of Contracts under Negotiated Procurement of the New Government Procurement Act (NGPA) or Republic Act No. 12009, adopted from the Government Procurement Reform Act (GPRA) or Republic Act No. 9184, recognizes the critical need for immediate action on government contracts that have been rescinded or terminated due to causes provided for in the contract and existing laws. This is essential to prevent damage to or loss of life or property, and to restore vital public services, infrastructure facilities, and other public utilities through the Negotiated Procurement – Take-Over of Contracts.
The NGPA retains this mode of procurement under Section 35, defining the Take-Over of Contracts as a necessary measure for contracts that have been rescinded or terminated, ensuring swift action to safeguard public interests. The implementing rules and regulations for this mode of procurement are currently underway.
