Under the Government Procurement Reform Act (GPRA) or Republic Act No. 9184, Negotiated Procurement through Emergency Cases provision allows the government to swiftly respond to imminent threats to life or property caused by natural or man-made calamities. This includes taking immediate action to prevent damage, loss of life, and restoring vital public services and infrastructure. The framework ensures that initial recovery steps are taken to mitigate any negative effects on well-being and property.

Similarly, the New Government Procurement Act (NGPA) or Republic Act No. 12009 maintains these Emergency Cases procurement provision under Negotiated Procurement of Section 35(b) of the NGPA. It recognizes the critical need for the government to address and resolve issues that require immediate action. In cases of imminent danger to life or property during a state of calamity, or when time is of the essence, the NGPA allows for the rapid procurement of necessary goods and services to prevent further damage, protect lives, and quickly restore essential public utilities and infrastructure. This streamlined process ensures efficient and timely government responses during emergencies, enhancing the delivery of public services and safeguarding the well-being of the community.
