Issues Concern: Request for the Exclusion of the Term “Reinsurance Services” under the Definition of Goods in the Draft Implementing Rules and Regulations Part A (IRR-A) of Republic Act No. 9184 (R.A. 9184)

We wish to inform you that this matter was discussed during the 5th GPPB Meeting held on September 10, 2003, at Unit 1103, The Taipan Place, Emerald Avenue, Ortigas Center, Pasig City. In this meeting, it was the consensus that, although not listed as an example under the term “goods,” a reinsurance service necessarily falls under the coverage of such term, because the definition of “goods” is structured broadly so as to exclude only those falling under the terms “infrastructure projects” and “consulting services.” Since a reinsurance service is neither an infrastructure project nor a consulting service, the members of the GPPB were of the opinion that it may fall under the general scope of the phrase “general support service.” Moreover, the GPPB unanimously agreed to maintain its previous decision to exclude reinsurance services as an example of highly specialized types of procurement under Limited Source Bidding, because of the general principle that all procurement shall be conducted through public bidding.
