Issues Concern: Request for Clarification on the Applicability of R.A. 9184 on the Engagement of Services of the Couples for Christ to Help Manage the Mainstreaming of Natural Family Planning in the Philippines Family Planning Program

Based upon your representations and the draft Memorandum of Agreement between DOH and CFC-MMFI that you presented to the GPPB, it appears that CFC-MMFI would not be charging any fee for its services, and that DOH would only pay for the actual expenses CFC-MMFI would incur in the management of the above-mentioned mainstreaming activities and initiatives, such as those incurred in connection with the purchase of supplies and equipment, the payment of honoraria for lectures, and other incidental expenses for such activities like seminars, conferences and meetings. It also appears that CFC-MMFI would have to return any unutilized amount remaining after the termination of the project, and that all equipment procured through the fund shall be owned and turned over to DOH.
In view of the foregoing, we would like to inform your office that the members of the GPPB unanimously agreed that the proposed contract, as discussed, does not appear to contravene Republic Act No. 9184, otherwise known as the “Government Procurement Reform Act,” and that DOH would have sufficient grounds to proceed with the said contract.
