Whether a Bid Securing Declaration which was erroneously addressed to the former DepEd Schools Division Superintendent may be a ground to disqualify a bidder.
The submission of the BSD must comply with the form and substance of a BSD pursuant to GPPB Resolution No. 15-2014. Failure to use the required BSD form shall be a ground for the disqualification of the bidder.
An examination of the BSD form merely requires addressing the same to the Procuring Entity and does not necessarily direct that it be addressed to a specific person. Thus, if the BSD submitted by the bidder conforms with the form as prescribed by the GPPB and is addressed to the Procuring Entity, the same has complied with the requirements under the 2016 revised Implementing Rules and Regulations (IRR) of Republic Act No. (RA) No. 9184, the Government Procurement Reform Act.
