The New Government Procurement Act (NGPA), or Republic Act No. 12009, adopted the Negotiated Procurement for United Nations (UN) Agencies, International Organizations, or International Financing Institutions from the Government Procurement Reform Act, or Republic Act No. 9184. This covers similar procurement but excludes infrastructure projects, focusing more on health and education, advanced technologies, and critical public health needs.

The NGPA enhances this negotiated mode of procurement by requiring certification from the DTI for advanced technologies and determination by the DOH for critical health goods, ensuring procurement is most advantageous to the procuring entity. This results in more efficient and advantageous procurement for the government, ultimately benefiting the public by ensuring access to essential goods and services.
