The Government Procurement Reform Act (GPRA) or Republic Act No. 9184 introduces the Negotiated Procurement for Scientific, Scholarly, or Artistic Work, Exclusive Technology, and Media Services, which may be used in circumstances where Goods, Infrastructure Projects, and Consulting Services can be contracted to a particular supplier, contractor, or consultant as determined by the Head of the Procuring Entity (HoPE). These circumstances include:
1. Work of art; commissioned work or services of an artist for a specific artistic skill (e.g., singer, poet, writer, painter, sculptor, etc.);
2. Scientific, academic, scholarly work or research, or legal services;
3. Highly specialized life-saving medical equipment, as certified by the Department of Health (DOH);
4. Scientific, technical, economic, business, trade or legal journal, magazine, paper, subscription, or other exclusive statistical publications and references; or
5. Media documentation, advertisement, or announcement through television, radio, newspaper, internet, and other communication media.
The New Government Procurement Act (NGPA) or Republic Act No. 12009 has adopted the Scientific, Scholarly, or Artistic Work, Exclusive Technology, and Media Services as a Negotiated Procurement and recognizes the need to preserve national heritage, boost tourism, create jobs, and promote sustainable development by 𝗶𝗻𝗰𝗹𝘂𝗱𝗶𝗻𝗴 𝗿𝗲𝘀𝘁𝗼𝗿𝗮𝘁𝗶𝘃𝗲 𝘄𝗼𝗿𝗸𝘀 𝗳𝗼𝗿 𝘁𝗵𝗲 𝗰𝗼𝗻𝘀𝗲𝗿𝘃𝗮𝘁𝗶𝗼𝗻 𝗼𝗳 𝗵𝗶𝘀𝘁𝗼𝗿𝗶𝗰𝗮𝗹 𝗮𝗻𝗱 𝗰𝘂𝗹𝘁𝘂𝗿𝗮𝗹𝗹𝘆 𝘀𝗶𝗴𝗻𝗶𝗳𝗶𝗰𝗮𝗻𝘁 𝘀𝘁𝗿𝘂𝗰𝘁𝘂𝗿𝗲𝘀 as an additional scope of this policy.
