Issues Concern: Discrepancy in Actual and Calculated Bid Prices

Details

1. Clarification on the prevailing amount in case of discrepancy between the amount in words and amount in figures.

Under Section 32.4.3 of the IRR-A of RA 9184, the bid price’s amount in words shall prevail over the amount in figures.

2. Clarification on the prevailing amount in case of discrepancy in the amount in words in the prospective bidder’s Financial Proposal and the Calculated Bid Price as evaluated and certified by the Technical Working Group.

A reading of [Sec. 37.1,] taken together with Sec. 32.4.3, leads us to the conclusion that the contract should be awarded to the bidder with the Lowest Calculated Responsive Bid at the amount determined to be whichever is lower between the actual submitted bid price in words and the evaluated, calculated bi price. Hence, in case of discrepancy between the two amounts, the lower shall prevail.
