Issues Concern: Applicability of the Revised IRR

Clarification on the applicability of Sections 62.2.3.3 and 62.2.3.4 of the revised IRR of RA 9184 to a procurement activity posted before the revised IRR took effect.

Please be advised that the revised IRR took effect last 2 September 2009. Its provision thus apply to all procurement activities where the invitation to bid were posted on or after 2 September 2009. If the invitation to bid was posted before 2 September 2009, then the provisions of the previous set of implementing rules shall apply.

[I]t appears that the invitation to bid for the infrastructure project was posted prior to 2 September 2009. Thus, the provisions of the revised IRR may not be applied to the case at hand.
