Issues Concern: Creation of Registry of Suppliers, Contractors, and Consultants

Whether the PNP-NHQ BAC can create a registry of suppliers, contractors, and consultants participating as bidders, in order for the BAC to examine the bidders’ documents and verify its completeness, and address the concern relative to the notable number of failed biddings due to bidders’ negligence in preparing their bidding documents.

Sections 23.4 and 24.4.3 of the revised Implementing Rules and Regulations (IRR) of Republic Act (RA) 9184 clearly allows the BAC of a procuring entity to “maintain a registry system using the Philippine Government Electronic Procurement System (PhilGEPS) or its own manual or electronic system that allows submission and/or recording of eligibility requirements simultaneously with registration.”

[H]owever, x x x prospective bidders not included in the registry system used by the procuring entity, whether the PhilGEPS or its own manual or electronic system, should not be precluded from participating in any procurement opportunity, and should be allowed to submit its Class “A” documents, together with its bid, prior to or during the deadline for the submission and opening of bids. Moreover, it should be stressed that inclusion in the registry system should not be considered an accreditation system, and is not tantamount to a finding of eligibility, nor a guarantee that the registered supplier, contractor, or consultant will be eligible for any particular procurement activity or contract award.
