Issues Concern: Date of Publication of R.A. 9184 and its IRR-A

Please be advised that R.A. 9184 was signed by Her Excellency President Gloria Macapagal-Arroyo on January 10, 2003 and was published in the issue of Manila Times and Malaya on January 11, 2003. Considering that Section 78 of R.A. 9184 provides that the law “shall take effect fifteen (15) days following its publication in the Official Gazette or in two (2) newspapers of general circulation,” R.A. 9184 became effective on January 26, 2003.

On the other hand, the IRR-A of R.A. 9184, which was approved by the President on September 18, 2003, was published in two (2) newspapers of general nationwide circulation, namely, Manila Times and Malaya, on September 23, 2003.

Considering that Section 78 of said IRR-A provides that it “shall take effect fifteen (15) calendar days after its publication in the Official Gazette or in a newspaper of general nationwide circulation,” counting fifteen (15) days thereafter, the IRR-A of R.A. 9184 became effective on October 8, 2003.
