

The New Government Procurement Act (NGPA) or the Republic Act No. 12009, retains the Negotiated Procurement for Highly Technical Consultants, which refers to the procurement of individual consultants hired to perform work that is either highly technical or proprietary, or primarily confidential or policy determining. Trust and confidence are the primary considerations for hiring these consultants. Under the NGPA, the term of the individual consultant is extended to a maximum of one year, renewable at the option of the appointing Head of the Procuring Entity (HoPE), but in no case shall it exceed the term of the HoPE.
The NGPA’s extension of the maximum term for Highly Technical Consultants from six months to one year provides greater stability and continuity of service for long-term projects, enhancing efficiency and trust in the procurement process.
