The ๐——๐—ถ๐—ฟ๐—ฒ๐—ฐ๐˜ ๐—ฆ๐—ฎ๐—น๐—ฒ๐˜€ mode of procurement under the New Government Procurement Act or Republic Act No. 12009 is a new approach designed to enhance the efficiency and timeliness of public service delivery. This method allows a Procuring Entity to directly purchase non-Common-Use Supplies and Equipment (non-CSEs) from a supplier that has previously delivered these items satisfactorily to another government agency but may only be resorted when ๐—”๐—Ÿ๐—Ÿ the following conditions are present:

๐Ÿ† ๐—ฃ๐—ฟ๐—ฒ๐˜ƒ๐—ถ๐—ผ๐˜‚๐˜€ ๐—ฆ๐˜‚๐—ฐ๐—ฐ๐—ฒ๐˜€๐˜€๐—ณ๐˜‚๐—น ๐—•๐—ถ๐—ฑ๐—ฑ๐—ถ๐—ป๐—ด: The initial procurement contract must have been awarded through a competitive bidding process.

โœ…๐—œ๐—ป๐˜€๐—ฝ๐—ฒ๐—ฐ๐˜๐—ถ๐—ผ๐—ป ๐—ฎ๐—ป๐—ฑ ๐—–๐—ฒ๐—ฟ๐˜๐—ถ๐—ณ๐—ถ๐—ฐ๐—ฎ๐˜๐—ถ๐—ผ๐—ป: The original procuring agency must have inspected, accepted, and certified the supplierโ€™s satisfactory performance.

โณ ๐—ง๐—ถ๐—บ๐—ฒ๐—น๐˜† ๐—ฃ๐—ฟ๐—ผ๐—ฐ๐˜‚๐—ฟ๐—ฒ๐—บ๐—ฒ๐—ป๐˜: The new procurement must be initiated once within six months of the original agencyโ€™s acceptance of the non-CSEs.

๐Ÿ’ฐ ๐—–๐—ผ๐˜€๐˜ ๐—˜๐—ณ๐—ณ๐—ถ๐—ฐ๐—ถ๐—ฒ๐—ป๐—ฐ๐˜†: The new contract must be within the amount of the contract made by the original government agency or the same or lower than the original contractโ€™s unit price.

๐Ÿ’ช ๐—ฆ๐˜‚๐—ฝ๐—ฝ๐—น๐—ถ๐—ฒ๐—ฟ ๐—–๐—ฎ๐—ฝ๐—ฎ๐—ฏ๐—ถ๐—น๐—ถ๐˜๐˜†: The supplier must agree to the new terms and remain legally, technically, and financially capable of fulfilling the contract.
