


The ๐๐ถ๐ฟ๐ฒ๐ฐ๐ ๐ฆ๐ฎ๐น๐ฒ๐ mode of procurement under the New Government Procurement Act or Republic Act No. 12009 is a new approach designed to enhance the efficiency and timeliness of public service delivery. This method allows a Procuring Entity to directly purchase non-Common-Use Supplies and Equipment (non-CSEs) from a supplier that has previously delivered these items satisfactorily to another government agency but may only be resorted when ๐๐๐ the following conditions are present:
๐ฃ๐ฟ๐ฒ๐๐ถ๐ผ๐๐ ๐ฆ๐๐ฐ๐ฐ๐ฒ๐๐๐ณ๐๐น ๐๐ถ๐ฑ๐ฑ๐ถ๐ป๐ด: The initial procurement contract must have been awarded through a competitive bidding process.
๐๐ป๐๐ฝ๐ฒ๐ฐ๐๐ถ๐ผ๐ป ๐ฎ๐ป๐ฑ ๐๐ฒ๐ฟ๐๐ถ๐ณ๐ถ๐ฐ๐ฎ๐๐ถ๐ผ๐ป: The original procuring agency must have inspected, accepted, and certified the supplierโs satisfactory performance.
๐ง๐ถ๐บ๐ฒ๐น๐ ๐ฃ๐ฟ๐ผ๐ฐ๐๐ฟ๐ฒ๐บ๐ฒ๐ป๐: The new procurement must be initiated once within six months of the original agencyโs acceptance of the non-CSEs.
๐๐ผ๐๐ ๐๐ณ๐ณ๐ถ๐ฐ๐ถ๐ฒ๐ป๐ฐ๐: The new contract must be within the amount of the contract made by the original government agency or the same or lower than the original contractโs unit price.
๐ฆ๐๐ฝ๐ฝ๐น๐ถ๐ฒ๐ฟ ๐๐ฎ๐ฝ๐ฎ๐ฏ๐ถ๐น๐ถ๐๐: The supplier must agree to the new terms and remain legally, technically, and financially capable of fulfilling the contract.
