Whether the Uniform Guidelines for Blacklisting of Manufacturers, Suppliers, Distributors, Contractors and Consultants (Guidelines) is applicable in cases of “undue practices” by a contractor who participated in the conduct of any of the alternative methods of procurement, specifically, shopping.
[T]he Guidelines shall govern the blacklisting of manufacturers, suppliers, distributors, contractors and consultants involved in government procurement for offenses or violations committed not only during the competitive bidding stage but also during contract implementation in accordance with Section 69 of the IRR-A of R.A. 9184.
Thus, the procuring entity can issue a Blacklisting Order disqualifying the erring contractor under the aforesaid section of the Guidelines whether the contract had been procured through public bidding or through any of the alternative methods of procurement.
