[T]he Municipality of Teresa is in the best position to determine, based on its primary purpose, motivation and intention, and on the nature of the contract, whether the intended Project should be classified as Goods or Consulting Services. In exercising this responsibility, the Procuring Entity should be guided by the parameters and conditions in the relevant provisions of Republic Act No. 9184 and its revised Implementing Rules and Regulations on what should be considered as Goods or Consulting Services procurement.
