Aligned with the fit-for-purpose approach, the New Government Procurement Act (NGPA) or Republic Act No. 12009 introduces Competitive Dialogue as one of the procurement modalities that the Procuring Entity (PE) may adopt. Competitive Dialogue under the NGPA is an innovative two-stage bidding process that invites suppliers, manufacturers, distributors, contractors, consultants, and service providers to propose tailored solutions through a collaborative dialogue under certain conditions.

Under the NGPA, Competitive Dialogue is particularly beneficial for projects involving innovative designs or complex purchases, such as sophisticated products, intellectual services, or major ICT projects. It is also ideal for contracts requiring detailed negotiations due to complexity, legal, or financial issues, and when technical specifications cannot be precisely defined.
