The New Government Procurement Act (NGPA) or Republic Act No. 12009 introduces significant changes to the Negotiated Mode of Procurement for Direct Retail Purchase adopted from the Government Procurement Reform Act (GPRA) or Republic Act No. 9184 (RA 9184), which includes Petroleum, Oil, and Lubricant (POL) products, airline tickets, and online subscriptions.

Under the NGPA, this mode now includes electronic charging devices which were not part of the scope under the previous GPRA or RA 9184. Notably, airline tickets, which were included in the GPRA, have been excluded from the NGPA and are now identified as common-used supplies and equipment (CSEs) by the Procurement Service of the Department of Budget and Management (PS-DBM). The acquisition of airline tickets is part of the pilot implementation of the eMarketplace of the Philippine Government Electronic Procurement System (PhilGEPS), following GPPB Resolution No. 06-2024.

The NGPA allows end-users to procure POL products, electronic charging devices, and online subscriptions directly from identified suppliers or service providers when these items are not available in PS-DBM. This change aims to ensure the efficient operations of Procuring Entities. The scope of online subscriptions includes computer software and applications such as video conferencing tools, computer-aided design and drafting applications, office productivity tools, and system protection software. It also covers electronic publications, reference materials, journals, off-the-shelf software and applications (excluding internet and cloud computing services), and web-based services.
