Commission on Audit and Government Procurement Policy Board Joint Memorandum Circular No. 1

Today, 26 March 2020, the Commission on Audit (COA) and the Government Procurement Policy Board (GPPB) issued Joint Memorandum Circular No. 1 “Emergency Procurement by the Government during a State of Public Health Emergency Arising from the Coronavirus Disease-2019 (COVID-19).”

Item 3.1 of the JMC recognizes the recent issuances of the GPPB to simplify and streamline the Rules on Emergency Procurement, as an exemption to Public Bidding under Republic Act (RA) No. 9184, that will enable Procuring Entities to efficiently and expediently undertake procurement during a State of Public Health Emergency.

Moreover, under Item 3.2, the COA and the GPPB confirms the authority given to Procuring Entities to use Negotiated Procurement (Emergency Cases) under Section 53(b) of RA No. 9184, Section 53.2 of its 2016 Implementing Rules and Regulations and associated issuances, in order for them to properly and timely respond to this Public Health Emergency.

The JMC was issued by the COA and the GPPB to further support the government’s efforts to mitigate, if not contain the transmission of COVID-19 through the expedient procurement of Goods, Infrastructure Projects and Consulting Services needed by our frontline workers who have been selflessly and tirelessly protecting all of us from this pandemic.
