Issues Concern: Technical Specifications
Whether the technical specifications for your procurement of Intravenous (IV) fluids are correct.
Section 17.2 of the 2016 revised IRR of RA 9184 provides that “[t]he specifications and other terms in the Bidding Documents shall reflect necessary specifications required to meet the needs of the Procuring Entity in clear and unambiguous terms.” Thus, it is the discretion of the WVSU Medical Center to require that the IV fluids be in plastic packaging based on its determined needs. It is worthy to stress, however, that in the development of the technical, performance, functionality and environmental requirements for a specific project procurement, the end-user or implementing unit shall not craft such specifications so as to forfeit or arrest wider participation of market operators, such as when specifications are patterned after, molded-to-form or tailor-fitted to a specific brand, product or design, that would prevent other market operators to participate.
